§ 5.48.010. Definitions.

  • For the purpose of this section, the following words and phrases shall have the meanings respectively ascribed to them by this rule:

    Child means any person under 12 years of age.

    Cruising means the solicitation of patrons upon a street other than from a taxi stand.

    Hackney means any power-driven hack, omnibus or other vehicle, whether on wheels or runners, except street buses, which shall be used for the conveyance of passengers from place to place for hire, and all such vehicles shall be deemed to be taxicabs or hackney carriages.

    Hackney license means a license approved by the chief of police and issued to the driver by the Lawrence Police hackney division to operate all vehicles for hire.

    Limousine means an unmarked luxury sedan with seating capacity of eight or less that is operated for hire, which is:

    1.

    Hired on a prearranged hourly basis for weddings, funerals, religious ceremonies or other social functions;

    2.

    Hired on an exclusive, dedicated basis for the duration of the event, not for drop-off and pickup; and

    3.

    Operated by the named insured, an employee, or an independent contractor of the named insured, in attendance as a chauffeur at the beginning and ending of the function.

    Livery means an unmarked (see section 5.48.340) for hire auto with a seating capacity of eight or less which:

    1.

    Is hired on a prearranged basis;

    2.

    Does not pick up a hail fares on the street;

    3.

    Does not contain a rate meter, and does not charge for services based upon miles traveled if the trip is less than 20 miles;

    4.

    Operates on a scheduled business day, and is returned to the vehicle's base of operation for a continuous period of a least four hours in each 24-hour period;

    5.

    Is operated by the named insured, an employee, or an independent contractor of the named insured, in attendance as a chauffeur;

    6.

    Operates from a base with two-way communication;

    7.

    Primary form of payment shall be by check or credit card;

    8.

    Is not for drop-off and pickup unless being utilized by an employment agency or nonprofit group, or for interstate travel that takes fares at least 20 miles out of the city;

    9.

    Are car dealerships and car rental agencies for the purpose of courtesy ride for their customers;

    10.

    All passengers in livery vehicle with seating capacity of eight or less should be considered one fare.

      NOTE: Any violation of these ten line items shall result in the suspension of the livery permit for a period of up to a month for the first offense and up to one year for multiple infractions.

    Livery permit means a permit granted by the Lawrence City Council and issued to a company, partnership, corporation or sole proprietorship intended to do business as a livery for hire on the pre-arranged basis or by contract. Permit shall be display on the right front windshield of the livery vehicle at all time. All contracts are subject to inspection by the hackney division to assure that no livery vehicles are being used as taxicabs.

    Operator means a person who has an operator's license from the commonwealth or other state to operate motor vehicles and also a license to operate vehicles for hire in the city.

    Protective partition means a divider between the front and rear portions of the passenger compartment of a hackney carriage that has been approved by the Lawrence Police Department hackney division prior to installation.

    Taxicab means a metered or unmetered motor vehicle with a seating capacity of seven or less that is operated for hire by or on behalf of the named insured or by an employee, but does not pickup, transport, or discharge passengers along a route.

    Taxicab medallion means a license granted by the Lawrence City Council and issued to a company, partnership, corporation or sole proprietorship intended to do business as a taxicab for hire in the City of Lawrence. Medallion shall be permanently affixed to the trunk lid of the taxicab at all time.

    Taxicab stand means any period of time that a taxicab, in the service of a passenger, shall be in an idle position waiting upon the convenience of the passenger.

    Vehicle for hire shall be used herein when referring to all of the aforementioned vehicles.

    Waiting time means any period of time that a taxicab, in the service of passenger, shall be in an idle position waiting upon the convenience of the passenger.
