§ 5.52.060. Issuance of a temporary license—License fee and hearing.

  • The city clerk, at the direction of the city council, shall be authorized to issue a license for the sale of such goods, wares and merchandise within the city pursuant to this section; provided, that the applicant has a transient vendor's license from the commonwealth, has paid a fee equal to the taxes assessable in the city, under the last preceding tax levy therein, upon an amount of property of the same valuation, but in no case less than $50.00, and complies with any and all requirements provided by law or city ordinance in effect. Determination of compliance with any and all conditions, laws or ordinances that may apply shall be within the sole and exclusive discretion of the city clerk and remain subject to review and further determination by the city council. Any and all fees shall be due and payable upon the issuance of the license to be issued pursuant to the provisions of this section. Any fee paid shall be credited toward payment of any fee assessed and paid as may be due and payable upon final approval of a permanent license issued by the city council pursuant to this section.

    Any license issued by the city clerk pursuant to this section shall be effective for a period not to exceed 45 days. Said license shall be identified and marked "TEMPORARY LICENSE" and shall expire on a date certain as affixed to the license issue which shall state as follows: "This license shall expire unless permanent approval by the city council is obtained on or before the date of expiration."

    Upon issuance of a "temporary license" pursuant to this section, the city clerk shall cause the "temporary license" issued to be presented to the city council in the form of a petition for review and approval of the application and "temporary license" and shall cause said petition to be scheduled for consideration at the next regular meeting of the city council. Any petition scheduled for hearing as provided herein shall proceed as any other petition filed for consideration of the city council.

    Any license issued by the city clerk shall be issued in accordance with the lawful provision of the city ordinances and the general laws of the commonwealth.
